Subject: Care of Mrs Evelyn Lovelock

Mr Gritten: Thankyou for Prof. Ann Sheen's reply dated 16 Dec stating that Wokingham PCT are responsible for my mother's care. Although I realise that Wokingham PCT may now be responsible, I still maintain my complaint that R B & B Trust were guilty of maladsministration in referring my mother to Social Services contrary to section 21 of the National Assistance Act 1948, in failing before discharge to arrange that my mother received 'free continuing care' as required by the Health Acts under the 'Coughlan Case' , and failing to give written reasons as required by booklet 25231 and the Ombudsman's recommendations in E208 /99-00 of 5th Nov, 2002'

Mrs Heatherington : This is a formal 'Complaint Letter' under Page Three of the NHS Complaints Pack - First stage - Local Resolution. This letter serves two purposes: 1) this is my formal request for your Hospital Trust to take 100% financial responsibility for the care now being provided for my mother in Holyport Lodge. 2) to provide you relevant information to assist you to make the right decisions in my mother's case, and many other similar cases I expect you will need to consider in the near future.

I attach my letter, REF ANJU4.RTF dated 19th November 2002 for your information, along with REF NHSC1.RTF 6th December 2002 and NHSC2.RTF 13th December 2002 to Mark Gritten, Chief Exec of Royal Berks & Battle Hospital Trust, copied to others including the Chief Execs of Thames Valley Health Authority and Reading Primary Care Trusts. You may also wish to read the latest information concerning unlawful practice within local authorities on www.NHSCare.info, since you may expect many other letters such as this in the future.

I apologize for the fact that this matter has gone public before this letter, but it was only today that I was informed yours was the PCT to be contacted. We are in the process of taking Power of Attorney, but this is not yet in force.
